Workers' Compensation Threshold
Georgia requires employers with 3 or more employees (full-time, part-time, or seasonal) to carry workers' compensation insurance (O.C.G.A. § 34-9-2); corporate officers/LLC members count toward that total once any employee is on staff. A corporation may exempt up to 5 corporate officers (an LLC up to 5 members) from individual coverage by written election to the insurer or the State Board of Workers' Compensation, but this does not remove them from the headcount used to determine whether coverage is required (O.C.G.A. § 34-9-2.1). Sole proprietors and partners with no employees are not required to carry coverage.
